REPLACEMENT OR REFUND.
A
customer may ask for a replacement or refund if the problem with the product is major.
Replaced products must be of the same type to the product originally supplied.
Refund should be the same amount from your original payment. For example, the
business may take into account how much time have passed since you bought the
goods considering the following factors,
Type of product,
when a customer provided a good, product or work of different type he has the
right to approach a seller for replacement. For example, According to Tanzania Sales of Goods Act Sec. 2 (a) states that
“an implied condition that the bulk shall correspond with the sample in
quality”. If is a Samsung TV of 27 inches should not be different. Failure to
do so, a customer may ask for replacement.
How a consumer is likely to use the product,
also a customer to make replacement or to be refund we have to calculate the lost
value or depreciation from the first day he received it.
The length of time for which it is reasonable for the product to be used,
here we consider time of usage by the customer hence replacement must rely on
it and not otherwise.
For
a major circumstances with the services you can cancel the contract and obtain
compensations or ask for refund for the drop in value of your services provided
by comparing to the price paid.

For example, according to Tanzania Sales of Goods Act Sec. 2 (1) states “specific goods”
means identified agreed upon at the time a contract of sale is made” this mean
a seller should deliver the goods according to the condition of the contract.

Also a customer when receives goods that are unfit he has the right to return
it to the supplier.
It doesn’t do what you asked for and can’t easily be fixed within a reasonable time,
also a product or good has a problems when are differently from the ordered
ones and the time is limited a factor that can disturb the customer activity.
It is unsafe,
this means a good is not in a good condition. Refer to Tanzania Sales of goods Act, Sec.
20 (c), where there is a contract for the sale of specific goods in a
deliverable state, the weight, measure
and test must be done by a customer and noticed, means if a customer is
unsatisfied the goods may be returned to supplier.
A service has a major problem when:-
It is substantially unfit for its common purpose and can’t easily be
fixed within a reasonable time. A supplier may provide a service that is under
low quality, if this occur a customer must get enough time to make sure that
the all problems are collected depending on the time he has.
It does not meet the specific purpose you asked for and cannot easily be
fixed within a reasonable time. Also the service provided by a supplier should
fulfill the needs of a customer. For example, water service to a construction
if are lucking a supplier must deal vividly with a supplier to protect his
rights of getting better service.
It creates an unsafe situation.
Also if the service is unsafe to a buyer he has the right to demand possible
solutions from the supplier, means to be refund or replaced with a proper
service.
THEREFORE, the
customer in order to ask for return, replacement or refund should reveal if
there is a condition dealt against by the supplier and determine the ways of
dealing with it. For example, the supplier may not accept compensation to the
buyer if the damages are caused by a customer whether in unloading of goods or
maintenance, and seller will review the stated time for compensation in the
contract.
