after agreement to buy a certain good or services is expecting to receive the
goods agreed in a good condition, failure of a seller to accomplish the prior
specification and agreement, a customer may return, ask for repair, refund or
replacement of goods.
RETURNING OF
THE PRODUCT, SERVICES OR WORK.
- You are entitled to return a product if you believe that there is a problem. You are generally responsible returning the product if it can be posted or easily returned. For example, according to the Sales of goods Act of 2002 ( S. 32 (1) “Where the seller delivers to the buyer the quantity of goods less than he contracted to sell, the buyer may reject them, but if the buyer accepts the goods so delivered he must pay for them at the contract rate.”
- When a product is too large, heavy or difficult to remove, the business is responsible for paying the transport costs or collecting the product within a reasonable time of being informed of the problem. For instance, a wide screen TV, bed, an extension ladder stuck in the extended position or a product that has been subsequently installed like a stove or a dishwasher.
- If the product is found not to have a problem, you may be required to pay the transport or inspection costs. An estimate of these costs should be provided to you before the product is collected and the costs must not be inflated in an attempt to defer you from pursuing your claims.
- Then approaching the supplier or manufacturer, the supplier who sold you the product or services cannot refuse to help you by sending you to the manufacturer or importer directly, however, you will only be entitled to recover costs from them which include an amount for reduction in the product value and in some cases compensation for damages.
REPAIR OF THE PRODUCT,
SERVICES OR WORK.
If the problem with a product or service is minor, you must accept a free repair if the business offers
one. If the business fails to give you a free repair within a reasonable time
or cannot fix your problem you can:-
- Ask for a replacement, this is the act of replacing one wrong goods or services with the correct ones, this is done if the goods are damages or differ from conditions or specifications provided by buyer to a seller in a contract document.
- Ask for a refund, here a customer want to be paid back his amount spent in purchasing of wrong goods or services or may ask for compensations from a seller or supplier. For example, this is done when the quality does not meet the price “Value for Money” (VfM)
- Recover compensation for the drop in value below the price paid, a customer may seek for compensation for damages and losses he face due to a problem with a product or service if the supplier could have reasonable foreseen the problem. The compensation that should be considered are those caused by a seller.
